1. Acceptance of Terms
By creating an account, clicking "I Agree," or using StorBrain, you agree to be legally bound by these Terms and all policies incorporated by reference. If using on behalf of a business, you represent you have authority to bind that entity.
2. Service Description
StorBrain is a cloud-based business intelligence and operations platform. Services include POS data integration, daily sales tracking, fuel management, employee time and attendance, lottery management, customer loyalty programs, AI-powered analytics, financial reporting, compliance tracking, multi-location management, and vendor and fleet portals.
We reserve the right to modify, suspend, or discontinue any feature with reasonable notice.
3. Eligibility
- Must be at least 18 years of age
- Must be authorized to do business in the United States
- Must have legal capacity to enter into binding contracts
- Must use the Service for legitimate business purposes only
- Platform is for business use only — not personal or household use
4. Accounts and Registration
Account Creation
You must provide accurate and complete information. You are responsible for maintaining its accuracy.
Account Security
You are responsible for all activity under your account. Notify us immediately of unauthorized access at support@storbrain.com.
Account Approval
New accounts are subject to StorBrain approval. We reserve the right to reject any application for any reason.
5. Subscriptions and Payment
Plans
Starter $69/mo · Growth $99/mo · Pro $179/mo · Enterprise $349/mo. Add-ons: Parking $79/mo, Fleet $59/mo, Truck Stop Bundle $119/mo. Prices subject to change with 30 days notice.
Billing
Billed monthly in advance. All fees in US Dollars. We use Stripe for payment processing — we do not store card numbers.
Failed Payments
If payment fails, we retry up to 3 times over 7 days. After that, account enters a grace period. Continued non-payment results in suspension.
6. Trial Period
Free Trial
A valid payment method is required to start a trial. At trial end, subscription begins automatically unless cancelled beforehand.
Reminders
We send reminders 7 days, 3 days, and 1 day before trial end.
One Trial Per Business
Only one trial permitted per business entity. Multiple accounts to circumvent this may result in permanent termination.
7. Cancellation and Termination
By You
Cancel anytime via account settings. Cancellation takes effect at end of current billing period. No prorated refunds.
7-Day Guarantee
Full refund within 7 days of your first payment (excluding trial-to-paid conversions). Email billing@storbrain.com.
By StorBrain
We may terminate immediately for: Terms violations, non-payment, fraudulent activity, false information, or security risks.
Effect of Termination
Access ceases immediately. Data retained 30 days then permanently deleted.
8. Acceptable Use
You may not use StorBrain for illegal activities, tax evasion, fraud, wage theft, lottery manipulation, platform hacking, unauthorized resale, or personal/household use. See our full Acceptable Use Policy.
9. Data Ownership
You retain full ownership of all data you input into StorBrain. We do not claim ownership of your business data. You grant us a limited license to process your data solely to provide our services. You may export data at any time.
10. AI Features
- AI outputs may contain errors or inaccuracies
- AI recommendations are informational only — not professional advice
- Do not make significant decisions based solely on AI recommendations
- StorBrain is not liable for losses from reliance on AI content
- Your data may be processed by Anthropic's AI systems
11. Intellectual Property
StorBrain, including its software, design, and content, is owned by StorBrain and protected by intellectual property laws. You receive a limited, non-exclusive license to use the platform during your subscription. You may not copy, modify, or reverse engineer StorBrain.
12. Disclaimer of Warranties
STORBRAIN IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT WARRANT UNINTERRUPTED SERVICE, ERROR-FREE OPERATION, OR THAT THE SERVICE WILL MEET YOUR SPECIFIC REQUIREMENTS.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, STORBRAIN SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES INCLUDING LOST PROFITS, DATA LOSS, OR BUSINESS INTERRUPTION.
Total liability is limited to the greater of: (a) fees paid in the 12 months preceding the claim, or (b) $100.
14. Indemnification
You agree to defend and indemnify StorBrain from claims arising from your use of the platform, your violation of these Terms, your violation of any law, or any data you submit to StorBrain.
15. Force Majeure
StorBrain is not liable for failures due to causes beyond our reasonable control including natural disasters, government actions, internet outages, third-party service failures (Vercel, Neon, Anthropic, Stripe), cyberattacks, or pandemics.
16. Governing Law
These Terms are governed by the laws of the State of Texas, United States. Disputes not subject to arbitration shall be resolved in courts of Harris County, Texas.
17. Arbitration & Class Action Waiver
Binding Arbitration
Disputes shall be settled by binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules, rather than in court.
Class Action Waiver
YOU WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION. Claims may only be brought in individual capacity.
Opt-Out
You may opt out within 30 days of first accepting these Terms by emailing legal@storbrain.com with your name, email, and statement that you wish to opt out.
Location
Arbitration shall take place in Houston, Texas, unless both parties agree to conduct it remotely.
18. Changes to Terms
Material changes will be communicated via email and in-platform notification and require re-acceptance. Continued use after the effective date constitutes acceptance.
